Violent offending encompasses all offending with an element of violence, whether that be a minor assault or wounding with intent to injure, right through to murder – and we regularly deal with all levels of violent offending.

Our approach is methodical and measured, reviewing the evidence and advising you as to the strengths and weakness of the prosecution case and any defences available.  We can also advise you on the process right from arrest through to sentencing or acquittal.

It’s important to take advice – and good, sound advice – early, especially if your intention is to plead guilty, because there a discounts available at sentencing for early guilty pleas.  Also, if we become involved early we can engage in charge discussions with a view to reducing your original charge.  But, it is also useful to know that you aren’t boxed in and you can successfully defend charges either through a lack of prosecution evidence, self-defence, defence of another, necessity or one of the other many defences.

EXAMPLES

December 2018

A client was charged with wounding with intent to cause grievous bodily harm and threatening to kill against their domestic partner.  Following a guilty plea, John obtained a sentence of 12 months home detention.

November 2018

A client was charged with injuring with intent to injure.   Following a guilty plea, John successfully obtained a discharge without conviction for the client, which is deemed an acquittal.

September 2018

A client was charged with wounding with intent to cause grievous bodily harm in a prison context.  Following a guilty plea, we obtained an end sentence of 4 years and 8 months’ imprisonment for the client.

August 2018

A client was charged with murder and aggravated robbery. Following a successful jury trial, the client was acquitted of murder but convicted of manslaughter.

July 2018

A client was charged with male assaults female.  John successfully defended the charge at trial and the client was acquitted.

May 2018

A client was charged with 9 charges of male assaults female. John successfully defended 8 of the charges at a jury trial and obtained acquittals on those charges. On the ninth charge which the client accepted, John obtained a discharge without conviction for the client, which is a deemed acquittal.

November 2017

Client charged with being a party to discharging a firearm with intent to cause grievous bodily harm and participating in an organised criminal group. John had the two charges of being a party to the discharge of a firearm dismissed at the end of the Crown case. On the remaining charge, the client was found not guilty.

December 2016

Client charged with threatening to kill.  Counsel made an application to the court for the charge to be dismissed, which was opposed by the Police.  The charge was dismissed.

November 2016

Client charged with wounding with intent to cause grievous bodily harm.  Counsel was able to have the charge reduced to wounding with intent to injure and the client successfully avoid prison getting 8 months’ home detention and a reparations order.

November 2016

Client was charged with common assault.  Police were looking to upgrade the charges and declined diversion.  Counsel successfully obtained diversion (meaning the charge was withdrawn) following a reconsideration of diversion.

September 2015

Client was charged with assault with intent to injure.  John successfully defended the matter at a jury trial securing a not guilty verdict.

August 2015

Client was charged with male assaults female.  John successfully defended the charges for the client at a Judge-alone trial and obtained a not guilty verdict.

August 2014

Client was charged with manslaughter. After obtaining reports from an overseas expert and a clinical psychologist, Counsel was able to have the charged reduced to assault with intent to injure and the defendant was discharged without conviction.
